You’ve received notice that the IRS has placed a levy against your wages or bank accounts. What does this mean? What can you do?
If things have gotten this far, you have probably been dealing with or ignoring the IRS for a long period of time. This is one of the strong-arm last resort measures they take. If your bank account is seized you have 21 days to prove that you do not owe the money. The bank is required by law to hold the seized money for that long. After that you’ll need to get a refund fromt he IRS, assuming you didn’t owe the tax.
If your wages are levied or garnished, don’t go screaming to your payroll clerk. Your employer has been ordered by a Federal Court to withhold the funds and remit them to the IRS. It’s a Federal offense to not comply with this order. You need to contact the IRS and if necessary, file a “Wrongful Levy Claim” as soon as possible. This is a situation where your first stop should be your local IRS field office. If you don’t get resolution there you need to consider hiring a professional to help. In most cases this is money well spent when matters have gotten this bad.
